WHO GETS THE HOUSE?

Assessing the value of the martial home or other shared properties is a big deal in the settlement process.

There are generally two options regarding shared property in a divorce:

  1. It can be sold and the proceeds divided
  2. One party can “buy out” the other.

In either case, one or both parties should order an appraisal of the residence. Now, a divorce appraisal is not the same as your typical appraisal used for lending purposes. They require a well supported, professional appraisal that is defensible in court.
